Access to and use of the website https://btlarchitecture.eu/ (hereinafter, the “Website”) implies the express and unreserved acceptance of these Terms and Conditions. Compliance with and adherence to these terms shall be enforceable against any person using the services in any manner.

PURPOSE

The purpose of this document is to establish the terms and conditions governing the use of the Website by any user who accesses and uses it, determining the rights and obligations of both BTL Architecture and the user, as well as any third parties who may be involved in the relationship between them. Before using the Website, users must carefully read these Terms and Conditions, as well as all other applicable legal documents, which must be expressly accepted by the user. These documents may be consulted, downloaded, and/or printed by the user at any time. BTL Architecture reserves the right to modify these Terms and Conditions, in whole or in part, by publishing any changes in the same manner or through other means of communication addressed to the Website’s users. Access to, browsing, and/or use of the services after any such changes take effect shall imply acceptance of those changes.

ACCESS AND USE

Users agree to use the Website in good faith, diligently and appropriately, at all times complying with these Terms and Conditions of Use, and not to misuse any information or content hosted on the Website.

Access to the service by individuals under the age of eighteen (18) is strictly prohibited. If the user sends any information or content of any kind to BTL Architecture, the user declares, guarantees, and agrees that they are entitled to do so freely, that such information does not infringe any intellectual or industrial property rights, trade secrets, or any other third-party rights, and that the information is not confidential and does not cause harm to third parties.

Links to third-party websites depend on each linked site and the contents of such pages are the sole responsibility of their owners. BTL Architecture is not responsible for the content of linked sites and does not guarantee their availability, as no periodic checks are made on their status.

LIABILITY AND WARRANTIES

BTL Architecture does not guarantee the availability or continuity of the operation of the Website or the services offered through it. Where reasonably possible, BTL Architecture will give prior notice of interruptions to the operation of the Website and services. BTL Architecture does not guarantee the usefulness of the Website or the services offered for any activity or business unrelated to BTL Architecture, nor their infallibility. BTL Architecture shall not be held liable for any damages that may result from the lack of availability or continuity of service, including, but not limited to, access failures to the Website or services provided.

BTL Architecture cannot fully control or guarantee the absence of viruses or other elements in the content that may cause alterations to the user’s IT systems (software and hardware), electronic documents, or files. BTL Architecture shall not be liable for any damages caused by viruses or other elements introduced by third parties outside BTL Architecture without its prior consent.

TERMINATION OF THE WEBSITE

BTL Architecture reserves the right to suspend, modify, restrict, or permanently or temporarily interrupt access, use, hosting, and/or downloading of content and/or use of the services, with or without prior notice, for users who violate any of the provisions of these Terms and Conditions, without entitling users to any form of compensation.

CONFIDENTIALITY AND DATA PROTECTION

All personal data collected during the use of the Website will be processed in accordance with the Privacy Policy, which users must accept in order to use the Website.

If users breach these Terms and Conditions, BTL Architecture may suspend or cancel their profile without prior notice and without any right to compensation. BTL Architecture may report to and cooperate with relevant law enforcement and judicial authorities if it detects violations of applicable laws or suspects criminal activity.

Should any provision of these Terms and Conditions be declared wholly or partially invalid or unenforceable by a competent court or authority, such invalidity shall not affect the remaining provisions. Failure by BTL Architecture to exercise or enforce any right or provision shall not constitute a waiver unless expressly acknowledged in writing.

APPLICABLE LAW AND JURISDICTION

Any dispute or matter arising from the Website or the execution and interpretation of this Agreement shall be governed by the principles of good faith and Cyprus law. In the event of judicial proceedings, the court of the user’s residence shall have jurisdiction, provided the user is considered a consumer and resides in Spain. If the user is not a consumer (i.e., a business or professional), or if the consumer resides outside Cyprus, both parties expressly submit to the courts of Nicosia, waiving any other jurisdiction.
